  1. Welcome to the Stacked Clothing website (the "Site"). In these terms, "Stacked Clothing" "we" or "us" means Stacked Clothing Limited, and any reference to "you" or "your" refers to the Site user.
  2. You agree to be bound by these Terms and Conditions by your use of the Site.
  3. If you have any questions regarding these Terms and Conditions or any of the policies contained in them, please contact us on info@stackedclothing.com.
  4. These Terms and Conditions include the Website Policy, Sales Policy, Returns Policy, Privacy Policy and Delivery Policy.
WEBSITE POLICY
  1. You may be required to provide personal information (such as identification or contact information) in order to take up offers displayed on the Site. You agree that any registration information you give to Stacked Clothing will be accurate, correct and up to date.
  2. You agree that Stacked Clothing may disclose your personal information (including but not limited to your name and contact details) to relevant authorities, any internet service provider that you use to access the Site, and/or the applicable intellectual property rights holders (or their representatives) if Stacked Clothing considers that you are infringing the intellectual property rights of any person.
  3. Any personal information provided to Stacked Clothing may be used and stored by Stacked Clothing in accordance with the Privacy Policy set out below.
  4. Stacked Clothing may vary these terms at any time and for any reason. Any variation will be effective on the posting of the terms on the Site.
  5. All information on the Site is protected by copyright.
  6. You may not display or redistribute any part of this Site without the prior written consent of Stacked Clothing.
  7. You may not use any trade mark on this Site without the prior written consent of Stacked Clothing or the relevant trade mark owner.
  8. You agree to indemnify Stacked Clothing for the cost of any claims arising from your unauthorised use of the intellectual property on this Site.
  9. Stacked Clothing will endeavour to keep this Site secure and free of errors. However, to the extent permitted by New Zealand law, Stacked Clothing will not be responsible for any damages arising from the use of this Site, including;
(a) any loss or damage caused by viruses that may be transmitted to your computer by use of the Site. Stacked Clothing expressly excludes any guarantees as to the security of the Site and any use is at your own risk; and
(b) any loss or damage arising from any errors in the information contained in the Site.
This limitation of liability applies to damages of any kind, including direct, indirect, incidental, loss of income, profit, data, property and claims by third parties.
  1. Stacked Clothing takes no responsibility for any other website linked to this Site. Any links are provided for your convenience as the Site user and Stacked Clothing takes no responsibility for any loss arising from the use of a linked website.
  2. You may not link to this Site from any other website, without the prior written consent of Stacked Clothing.
  3. You may not use this Site for any illegal activity.
  4. These Terms and Conditions are governed by the laws of New Zealand.
SALES POLICY
  1. The prices displayed on the Site apply to online sales only and different prices may apply to any in-store sales.
  2. Stacked Clothing makes every effort to provide high quality images of items for sale; however you acknowledge that the actual colours of an item may differ slightly to those displayed on screen. Stacked Clothing does not guarantee that your monitor's display of any colour will be accurate.
  3. Goods are subject to availability and Stacked Clothing does not guarantee that all items advertised on the Site will be available at all times. If you order an item that is out of stock, Stacked Clothing will refund you the purchase price of the goods.
  4. Stacked Clothing has the right to accept or reject any order for any reason.
  5. All prices are in New Zealand Dollars unless otherwise stated.
  6. Sizes indicated are New Zealand sizes unless otherwise stated.
  7. Prices include Goods and Services Tax (If any) at the current rate of 15% set by the New Zealand government.
  8. An order is deemed complete when payment has been successfully received in full by Stacked Clothing. Once an order is complete you are unable to cancel the order, so please check the details carefully before confirming your purchase.
  9. By placing an order you warrant that all the details you provide are correct and that you are authorised to use the credit card you use to place the order.
  10. You must maintain the confidentiality of your username and password used to access the Site. You agree to indemnify Stacked Clothing for any claims arising from your failure to keep these details confidential. You are solely responsible for any activity that occurs under your account, whether or not you are aware of or have authorised the activity. You must alert Stacked Clothing as soon as you become aware of any unauthorised activity occurring on your account.
  11. In the event of a typographical price error on our Site, Stacked Clothing has the right to refuse or terminate the sale. In the event that this happens, you will be notified.
  12. Stacked Clothing may alter the products available and the prices of those products, at any time before an order is placed and without notice.
  13. Nothing in these Terms and Conditions affect your consumer rights under any statute. If you are purchasing items for purposes other than for personal, domestic or household use or consumption, the Consumer Guarantees Act 1993 will not apply.
  14. Stacked Clothing's liability is limited to its obligations to refund, repair or exchange faulty items under the Consumer Guarantees Act 1993.
  15. When you place an order you will receive a confirmation email with the details of your purchase. You must retain this email as proof of purchase for the purposes of any returns or any other claims against Stacked Clothing.
  16. Stacked Clothing is not able to offer refunds on items because they are made of materials you are unable to wear, for example due to allergies.
RETURNS POLICY
  1. This Returns Policy only applies to goods purchased through the Site, and not for sales made through retail stores or via third party websites.
  2. Stacked Clothing will comply with our obligations under the Consumer Guarantees Act 1993 in respect of faulty items. 'Faulty' in this context includes items that:
(a) are damaged, other than normal wear and tear;
(b) are not of acceptable quality; or
(c) do not match the description Stacked Clothing gave you when you made your purchase.
  1. If you want to return faulty goods, please contact us on info@stackedclothing.com within 20 working days of the shipment being dispatched. Stacked Clothing must deem this product to be faulty and we will require images of the fault. If we decide the product is faulty you must return it to us and postage will be at our cost.
  2. You must comply with all care instructions provided for the item or the goods will not be deemed faulty.
  3. If an item is deemed to be faulty, Stacked Clothing will (at its choice) refund the purchase price, fix the defect, or exchange the item for a similar item that is not faulty.
  4. Unfortunately Stacked Clothing is unable to provide you with a remedy for goods that were not faulty at the time they were delivered to you. This includes you changing your mind about something you have bought (if there is nothing otherwise wrong with it) or finding the item is the wrong size or a different colour to what you thought.
  5. If you change your mind about a purchase, Stacked Clothing has the option to offer you a refund, exchange or credit note. However, this is at Stacked Clothing's sole discretion and will apply on a case by case basis.
  6. For hygiene reasons, Stacked Clothing cannot offer refunds on Underwear or Snapbacks.
  7. If a refund is due to you it will be made via bank deposit, after Stacked Clothing has received the faulty product.
PRIVACY POLICY
  1. If you have any questions regarding this privacy statement or wish to view or amend the personal information that we hold about you please contact us directly at info@stackedclothing.com.
  2. In completing and submitting an order, you are required to provide Stacked Clothing with personal information. Stacked Clothing must comply with privacy legislation when dealing with personal information. We respect your privacy and comply with the Privacy Act 1993.
  3. We will only ask you for the information necessary to complete your order such as your name, email address, delivery address and telephone number.
  4. You are entitled to access the personal information we hold about you, and request that we amend it if it is incorrect.
  5. Stacked Clothing will not disclose your personal information to any third party unless you have instructed or authorized us to do so in advance, or in accordance with clause 2 of the Website Policy above.
  6. Your email address may be used in private correspondence with you for customer service issues like deliveries, promotions or competitions. You can choose not to receive emails related to promotions or competitions.
  7. Stacked Clothing does not use the personal details it collects as a source for unsolicited emails or unsolicited postal mail.
  8. Our online payment requires you to use the Payment Express system. By using this payment method we do not need to record any of your credit card details. For more information on this payment system go to www.paymentsexpress.com.
  9. Stacked Clothing has electronic and physical security measures in place to protect against the loss, access, misuse and, alteration and/or unauthorised disclosure of the information under our control. Please be advised, however, that while Stacked Clothing strives to do everything reasonably possible to protect your personal information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to Stacked Clothing and cannot be responsible for the theft, destruction, or inadvertent disclosure of your personal information where our security measures have been breached. These activities are conducted at your own risk.
  10. Wherever Stacked Clothing has links or references to other websites from our Site, our Privacy Policy does not cover those sites. Stacked Clothing takes no responsibility for the privacy practices of other websites.
  11. Our Site is accessed by people all over the world, in different countries with different laws. By visiting our Site and providing us with data, you acknowledge and agree that your personal information may be processed for the purposes identified in this policy. In addition, such data may be stored on servers located outside your resident jurisdiction, which may have less stringent privacy practices than your own. By providing us with your data, you consent to the transfer of such data.
DELIVERY POLICY
  1. Stacked Clothing charges a flat delivery price of $6 per order within New Zealand, regardless of how many items you purchase. Delivery prices are subject to change at any time.
  2. Delivery prices are additional to the purchase prices displayed on the Site. The delivery price for your order will be shown in the final amount payable, prior to you placing your order.
  3. Orders received by 10am on a working day will be processed and dispatched that day. Orders received after 10am, or on a day that is not a working day, will be processed and dispatched the next working day.
  4. Deliveries within the South Island will be made within 1-3 working days of dispatch. Deliveries within the North Island will be made within 2-4 working days of dispatch.
  5. Stacked Clothing ships world wide using NZ Post Air mail service. Please note that for any international shipping Stacked Clothing has no control over any import taxes that the parcel may incur when it reaches the country of destination. Stacked Clothing will not be liable for these costs.
  6. If you make an order during December, Stacked Clothing cannot guarantee your items will arrive within the timeframes stated above, due to seasonal demand.
  7. All New Zealand deliveries are made by Fastway couriers, If you would like the trace number please email us. International deliveries are made by NZPost International air mail.
  8. Your items will be delivered during working hours, so please make sure someone is home to receive them. If there is nobody at home when your items are delivered, the courier will try to leave your items in a safe place. If there is no safe place to leave them, the courier will leave a card asking that you collect your items from a postal collection entre. It is your responsibility to collect your items and Stacked Clothing will not reimburse you for any associated costs.
  9. If you do not receive in an order an item you purchased, please email us on info@stackedclothing.com and we will send out the correct order free of charge. Please let us know about the error as soon as possible or Stacked Clothing will be unable to guarantee that the item will be in stock.
  10. If you receive an item that you did not order, please contact us on info@stackedclothing.com to let us know. We will arrange with you the best way to collect the incorrect items.
